Pre–trial resolution of the conflict through mediation

The success story in the framework of the "Living in peace" project.

Two teenagers having the conflict in escalation stage were referred to the mediator within the framework of the Yntymaktuu Zhashoo (Living in Peace) project by a social worker of the municipality.

Both teenagers were engaged in street trade as a summer side job. Previously, Asel and Nargiza worked as sellers for the same owner of retail outlet.

Teenagers came to the mediator with their lawyers intending to sue for getting bodily injury during the conflict. The conflict occurred due to the fact that currently teenagers were working as sellers for different owners, periodically they had clashes on minor issues at work. As a result, there was a conflict where both were injured during the fight. Asel believed that she had suffered more than Nargiza and filed a complaint to law enforcement agencies. At this stage, the social workers of the municipality were involved, since the conflicting parties were minors. The social worker, seeing the need to resolve the conflict in a pre-trial manner, brought the teenagers to the mediation procedure. Both teenagers came to the mediator with their lawyers.

During the meeting, the mediator analyzed the availability to solve the conflict through mediation, without trial. Thus, in the process of investigating the dispute by the mediator, it was revealed that teenagers do not have critical claims against each other. At the same time, the manipulation of teenagers and interest in the conflict between the owners of different outlets where they currently worked were revealed. The mediation process involved parents of children, as well as their employers to identify their interests and stop further manipulations about luring clients.

As a result of the successful work carried out by the mediator, the parties came to reconciliation, withdrew their complaints from law enforcement agencies and concluded a mediation agreement that guaranteed the teenagers further work in a calm environment.
